The crux of the argument is that Amtrak should have known that this trespassing was occurring. Because the shortcut was well-known and actively used, Amtrak became responsible for the safety of those who ventured onto the track. “It is also alleged and therefore averred that Amtrak knew or should have known that a complete, well-maintained fence was necessary to prevent children from trespassing on its train tracks.
